Indonesia is a country with a significant number of migrant workers being sent abroad. In 2020, Indonesia became the second-largest sender of migrant workers in Southeast Asia after the Philippines. In 2023, around 230,823 have registered as Indonesian migrant workers. This phenomenon occurs due to the limited job opportunities in Indonesia itself. In practice, there are many Indonesian migrant workers who choose illegal routes to obtain those jobs, commonly referred to as migrant workers. Becoming a migrant worker will lead to another problem, namely the unfulfilled rights of migrant workers that they should receive. One of them is the education allowance for the children of migrant workers. Based on related research, children of Indonesian migrant workers only receive education at the elementary school level. Children of Indonesian migrant workers have the same potential issues in terms of obtaining the right to education. The purpose of this research is to analyze how Indonesia protects the right to education for Indonesian migrant workers' children in the destination countries. This research includes an inventory of positive law, legal principles, and the level of synchronization (in this paper, the term harmonization is used) both vertically and horizontally. The legal materials used include primary legal materials, secondary legal materials, and non-legal materials. This research is important to conduct because its aim is to understand the forms of protection for migrant workers' children regarding their educational rights in Indonesia and to comprehend the practices of fulfilling the educational rights of Indonesian migrant workers' children in the destination countries.
